Terms of Service

1. Acceptance of Terms

By accessing and using RackServer's services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

RackServer provides enterprise infrastructure services including dedicated servers, GPU compute clusters, colocation services, and managed hosting solutions. All services are subject to the specific terms outlined in your service agreement and this general Terms of Service.

3. Service Level Agreement (SLA)

RackServer guarantees 99.99% network uptime for all dedicated server and colocation services. In the event of downtime exceeding the SLA, customers are eligible for service credits as outlined in their individual service agreement. SLA excludes scheduled maintenance windows which are communicated at least 72 hours in advance.

4. Acceptable Use Policy

You agree not to use RackServer services to:

• Engage in any illegal activity or facilitate violations of law
• Distribute malware, viruses, or other harmful code
• Launch denial-of-service attacks or network reconnaissance against third parties
• Store or transmit content that infringes intellectual property rights
• Send unsolicited bulk emails (spam)
• Bypass or attempt to bypass security measures

5. Payment Terms

All services are billed monthly unless otherwise specified in your service agreement. Payment is due within 15 days of invoice date. Late payments may incur a fee of 1.5% per month. RackServer reserves the right to suspend services for accounts with overdue payments exceeding 30 days.

6. Data Ownership

You retain all rights, title, and interest in and to your data. RackServer does not access, use, or share your data except as necessary to provide the services you have requested. Upon termination, you may request the return or deletion of your data within 30 days.

7. Limitation of Liability

RackServer's total liability for any claims arising from the use of our services shall not exceed the total amount paid by you during the twelve (12) months preceding the claim. RackServer shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

8. Termination

Either party may terminate services with 30 days written notice. RackServer reserves the right to immediately terminate services for violations of the Acceptable Use Policy. Upon termination, all outstanding fees become immediately due.
